How Spore Laws Work

Here’s the key distinction most people don’t know: psilocybin mushroom spores do not contain psilocybin or psilocin — the compounds classified as Schedule I controlled substances under federal law. The psychoactive compounds are only produced when a mushroom fruit body develops.

Because spores themselves contain no controlled substances, they are legal to possess, buy, and sell in most US states when intended for legitimate research purposes such as microscopy, taxonomy study, and scientific education.

However, a small number of states have passed their own laws that restrict or ban spore sales regardless of intent. HelloSpore strictly complies with all state and federal laws.

🚫 States Where We Cannot Ship

HelloSpore does not sell or ship spore products to the following states:

California

California law (Health & Safety Code § 11054) classifies spores capable of producing psilocybin mushrooms as illegal when sold with intent to cultivate. While spores themselves don’t contain psilocybin, California’s broad interpretation of “precursor” materials effectively prohibits commercial spore sales. We do not ship to California.

Idaho

Idaho has the strictest spore laws in the country. Under Idaho Code § 37-2705, the state classifies psilocybin mushroom spores themselves as a controlled substance — not just the fruiting bodies. Possession of spores is illegal regardless of intent. We do not ship to Idaho.

Georgia

Georgia law (O.C.G.A. § 16-13-25) includes psilocybin spores in its Schedule I controlled substance list. Like Idaho, Georgia does not distinguish between spores and mature mushrooms under its drug statutes. We do not ship to Georgia.

Florida

As of 2025, Florida has banned the sale and possession of psilocybin mushroom spores. House Bill 651 (HB651), signed into law by Governor DeSantis, criminalized spore distribution even though spores contain no psychoactive compounds. This made Florida the fourth state to ban spore sales. We do not ship to Florida.

✅ States Where Spore Sales Are Legal

In the remaining 46 states, psilocybin mushroom spores are legal to purchase and possess for microscopy and research purposes. This includes states like:

  • Oregon — Has additionally legalized supervised psilocybin therapy (Measure 109)
  • Colorado — Has decriminalized psilocybin possession and passed Proposition 122 for regulated access
  • Washington, Texas, New York, Illinois, Ohio, Michigan — All permit spore sales for research
  • All other states not listed in the restricted section above

Even in states where spores are legal, they must be purchased and used solely for microscopy, taxonomy, and educational purposes. Cultivating psilocybin mushrooms remains illegal under federal law (21 U.S.C. § 841) in all states except where specific state programs exist (e.g., Oregon’s licensed service centers).
